Information per Art 28 (1) EU Data Act:

1. The jurisdiction to which the ICT infrastructure for our individual services is subject is as follows:

• Payment Orchestration Operations: Austria.

• Standalone Payment Modules & Card Account Updater: USA.

2. Protective Measures and Safeguards:

IXOPAY applies comprehensive technical, organisational, and contractual measures to protect all customer data.

We protect non-personal data covered by the EU Data Act by applying the same comprehensive technical, organisational, and contractual measures established for personal data under the GDPR.

These safeguards are designed to prevent unauthorized access or transfer. Our technical and organisational measures include robust encryption, strict access controls, and regular security assessments, with a detailed description publicly available on our IXOPAY TOMs page.

Our contractual commitments with (non-EU) subcontractors include clauses that legally require them to notify us of and challenge any governmental access request or transfer of data where such access or transfer would create a conflict with EU law or the national law of the relevant Member State. Furthermore, all IXOPAY personnel are bound by strict confidentiality obligations.
